Terms of Use

By using the Application, you agree to be bound by the following terms, which govern the legal relationship between you and "Naqsh".

1. Design Guidelines (Uploaded & AI-Generated)

All designs, whether uploaded by the user from their device or generated using the in-app Artificial Intelligence tools, are subject to review and moderation.

Prohibited Content: It is strictly prohibited to use the Application to create, upload, or print any content that includes:

• Profane, abusive language, or content that incites hatred or violence.
• Pornographic or sexually explicit content, or immoral suggestions.
• Seditious political slogans or symbols that violate state laws or societal norms.
• Infringement of third-party intellectual property rights (e.g., global trademarks, protected characters).

Right to Reject: "Naqsh" reserves the absolute and exclusive right to refuse to print any design deemed non-compliant with these standards, without the need to provide reasons.

2. Penalties and Account Termination

AI Violations: Since we have full access to AI-generated images, any attempt to use these tools to generate prohibited content (pornographic, violent, abusive, etc.) will be treated exactly the same as uploading prohibited images.

Actions: In the event of a proven violation, the Application administration reserves the right to:

• Immediately cancel the order.
• Impose a permanent or temporary ban on the user's account and device (Device Ban).
• Report the user to the competent Cybercrime authorities if the content constitutes a serious criminal offense.

3. Orders, Returns, and Exchange Policy

Custom-Made Products: The user acknowledges that products printed based on their request (whether via uploaded or generated images) are personalized products that cannot be resold. Therefore, the user is not entitled to request a return, exchange, or cancellation after execution has begun, except in the case of a clear manufacturing defect.

Manufacturing Defects: These include (product tearing, breakage, or gross printing errors on our part). They do not include (user dissatisfaction with the design they selected themselves, or slight color variations resulting from the difference between digital screens and actual printing).

Trends Section: Pre-made products are subject to the same manufacturing defect policy, and any issue must be reported within 48 hours of receipt.

4. Shipping and Delivery

• The standard delivery time is up to 7 business days from the date of order confirmation.
• Force Majeure: In cases of Force Majeure (security closures, natural disasters, pandemics, shipping company strikes), the Company shall not be held liable for delays, and the user is not entitled to cancel the order for this reason, provided that the Company acts to deliver the order as soon as the impediment is removed, with a maximum limit of 15 days from the date of order confirmation.

5. Limitation of Liability

To the maximum extent permitted by applicable law:

• Color Accuracy and Quality: "Naqsh" does not guarantee a 100% match between colors displayed on digital screens and printed colors, as printing relies on materials and inks whose properties may vary.
• AI Errors: AI tools are technical aids. The Company assumes no responsibility for any "Hallucinations" or inaccurate/strange results appearing in generated images. The user is solely responsible for reviewing and approving the generated image before finalizing the order.
• Usage: The Company accepts no liability for any direct or indirect damages resulting from the use of, or inability to use, the Application.

6. Intellectual Property

• The user retains ownership of the images they upload but grants "Naqsh" a non-exclusive license to use these images for the sole purpose of fulfilling the order.
• All intellectual property rights regarding the Application (code, design, user interface, logo) are the exclusive property of "Naqsh". Copying or reverse engineering the Application is prohibited.

7. Payment and Financial Transactions

• Currently, the approved payment method is Cash on Delivery (COD).
• Fake Orders: In the event of repeated fake orders ("ordering and refusing receipt"), the user will be placed on a Blacklist, and their data will be shared with local delivery company databases to warn against dealing with them, in addition to legal pursuit for damages.

8. Indemnification

The user agrees to indemnify, defend, and hold harmless "Naqsh," its employees, and agents from any claims, losses, liabilities, or expenses (including legal fees) arising from:

• The user's breach of these terms.
• The user's violation of any third-party rights (such as copyright for an uploaded or generated image).
• Misuse of AI services.

9. Amendments and Governing Law

• We reserve the right to amend this policy at any time. Your continued use of the Application constitutes agreement to such amendments.
• These terms are governed by and interpreted in accordance with the laws applicable in Palestine. The courts of Nablus city shall have exclusive jurisdiction to settle any dispute.
